The lawyers claim Daniels sued with \u201cabsurd allegations\u201d because she was upset her assistant job did not \u201cgrant her direct access to Lizzo\u201d to pitch costume ideas and play with designs.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cOnce [Daniels] joined the tour, it was immediately evident that she felt the role was beneath her,\u201d the 34-page filing obtained by <em>Rolling Stone<\/em> reads. \u201cTo add insult to injury, Daniels got no closer to Lizzo than occasionally smiling at her in passing.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tIn response to the new motion for summary judgment, Daniels\u2019 lead lawyer, Ronald Zambrano, says he\u2019s not worried.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cWe fully expected the defense to file a motion to dismiss. We also fully expect the judge to deny the motion, and we look forward to taking this case to trial and winning,\u201d Zambrano says in a statement. \u201cThe motion is meritless, and the defense knows it, but their modus operandi is to treat all lawsuits as having no grounds to proceed by repeatedly blaming the victim. It won\u2019t work.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tAccording to the new motion filed in federal court in Los Angeles, Daniels has not produced \u201ca single witness\u201d to back up the complaints of a hostile work environment she started making involving Nomura during her first few days on the job. The lawyers say Daniels\u2019 allegations that she never received accommodations for an ankle injury, an allergic reaction, and two broken acrylic nails that caused her nail beds to bleed were baseless. The lawyers fault Daniels for wearing slide-on gym shoes or Crocs during her work hours, not asking for crutches, and failing to request a ladder for her bunk bed on the tour bus.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cShe could not reasonably believe that a rolled ankle, broken acrylic nails or feeling \u2018woozy\u2019 are disabilities under the ADA,\u201d the new filing reads. The lawyers say Daniels \u201cmay not have liked the way Nomura allegedly behaved,\u201d but \u201cnone of the complained-of conduct that allegedly offended Daniels is actionable discrimination or retaliation under federal law.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tWith the new motion, Lizzo\u2019s lawyers are asking the judge to step in and rule that the superstar\u2019s touring company, Big Grrrl, has no liability based on the stated claims and evidence so far. Last December, the court granted a similar motion in Lizzo\u2019s favor, <a data-id=\"https:\/\/www.rollingstone.com\/music\/music-news\/lizzo-dismissed-harassment-lawsuit-wardrobe-assistant-1235194368\/\" data-type=\"link\" href=\"https:\/\/www.rollingstone.com\/music\/music-news\/lizzo-dismissed-harassment-lawsuit-wardrobe-assistant-1235194368\/\">cutting her loose<\/a> as an individual defendant, apart from her company.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tDaniels <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/lizzo-new-lawsuit-tour-wardrobe-designer-racial-sexual-harassment-1234829185\/\">first filed her lawsuit in Sept. 2023<\/a>, alleging the atmosphere on Lizzo\u2019s tour subjected her to \u201cracist and fat phobic comments,\u201d sexual harassment, and disability discrimination. She claimed Nomura physically injured her by rolling a \u201cheavy clothing rack\u201d over her foot.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tIn a text exchange included in court documents, Daniels told Gugliotta that Nomura \u201cran over\u201d her foot with the rack and pushed her. Lizzo has <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/lizzo-denies-false-allegations-dancers-lawsuit-1234800044\/\">denied the claims<\/a>. In a March 2024 Instagram post, the \u201cTruth Hurts\u201d singer said <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/lizzo-i-quit-statement-1234996835\/\">she was considering quitting the industry<\/a>.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cI\u2019m getting tired of putting up with being dragged by everyone in my life and on the internet.
