Last year, Neil Young<\/a> began to play shows<\/a> with a new backing band that he called the Chrome Hearts<\/a>. Then, in June, Neil Young and the Chrome Hearts\u2014featuring Young, Micah Nelson, Corey McCormick, Anthony Logerfo, and Spooner Oldham\u2014released their debut album, Talkin to the Trees<\/em><\/a>. Now, Young and his bandmates are being sued by the Los Angeles fashion brand Chrome Hearts<\/a> for trademark infringement.<\/p>\n

Chrome Hearts LLC filed its complaint in a California federal court on Thursday, September 11. The lawsuit was first reported by Billboard<\/em><\/a>.<\/p>\n

In the complaint, obtained by Pitchfork, lawyers for Chrome Hearts outline the brand\u2019s ownership \u201cof the CHROME HEARTS\u00ae word mark, and composite trademarks comprising the CHROME HEARTS mark and design components,\u201d dating back to 1991.<\/p>\n

They argue that Young and his bandmates are infringing upon the brand\u2019s trademark by selling \u201cNeil Young and the Chrome Hearts\u201d (NYTCH) merchandise that \u201cincorporates the exact CHROME HEARTS\u00ae word mark and is thus likely to cause confusion with Chrome Hearts\u2019 various Chrome Hearts Marks.\u201d<\/p>\n

\u201cThe likelihood of confusion is not merely hypothetical. Some clothing and apparel vendors have apparently already mistakenly assumed that there is a connection between NYTCH and Chrome Hearts, and are actively promoting that purported connection,\u201d they claim. \u201cFor example, some vendors have started marketing t-shirts that prominently display Mr. Young\u2019s name along with Chrome Hearts\u2019s iconic stylization of the CHROME HEARTS\u00ae mark.\u201d<\/p>\n

According to the complaint, Chrome Hearts notified Young\u2019s team in July about the alleged trademark infringement, but the band continued to tour<\/a> under the banner and sell merchandise. Through the lawsuit, Chrome Hearts is now requesting that Neil Young and the Chrome Hearts stop using the name.<\/p>\n

Pitchfork has reached out to representatives for Neil Young and the Chrome Hearts and lawyers for Chrome Hearts LLC for comment.<\/p>\n<\/div>\n
