\n\tThe former Yeezy<\/a> marketing specialist who claims Kanye West<\/a> subjected her to \u201cantisemitic vitriol,\u201d sexual harassment, and retaliation was awarded $76,245 in attorneys\u2019 fees Friday for her victory over West\u2019s early attempt to dismiss her lawsuit on free speech grounds.<\/p>\n

\n\tA California judge awarded the fees at a morning hearing in downtown Los Angeles. The Jane Doe plaintiff originally asked for $99,720<\/a> in legal fees and costs, but her lawyer said the reduced amount was acceptable too.<\/p>\n

\n\tWest\u2019s new lawyer on the case, Andrew Cherkasky, argued unsuccessfully that the court should wait to order the fee payment because West is appealing the underlying ruling that trashed his First Amendment challenge to Jane Doe\u2019s lawsuit as \u201cfrivolous.\u201d The judge said the appellate court might take a year or more to rule on the underlying case, and he didn\u2019t want to delay anything. He said West could simply appeal the fee award as well.<\/p>\n

\n\t\u201cWe certainly do think there are very interesting First Amendment issues that could lead to additional appeals,\u201d Cherkasky said at the end of the hearing. \u201cAt this point, we intend to aggressively move along with litigation,\u201d if the appellate court upholds the lawsuit, he said. (The lawsuit is currently on hold pending the outcome of West\u2019s appeal. If West is denied again, the next step will be to set a trial date, the judge said Friday.)<\/p>\n

\n\tIn his written ruling adopted from the bench, Los Angeles County Judge Nicholas F. Daum awarded the $76,245 in attorneys\u2019 fees after reviewing the decision by his predecessor judge that found West\u2019s motion to strike was a baseless stalling tactic. Daum said he agreed that the motion was \u201cindeed frivolous.\u201d<\/p>\n

\n\tThe Jane Doe plaintiff brought her lawsuit<\/a> in February. In the 34-page complaint, obtained by Rolling Stone<\/em>, she said her turbulent tenure working for West\u2019s company Yeezy in late 2023 and 2024 was a minefield of anti-semitic verbal abuse, discrimination, and \u201cconstant degradation of women.\u201d<\/p>\n

\n\tThe woman claims that West, also known as Ye, sent her harassing texts reading, \u201cWelcome to the first day of working for Hitler,\u201d and \u201cHail Hitler,\u201d before her abrupt termination when she reported West\u2019s behavior to her manager. She further claims West once texted her a photo of a nude woman and ordered her to work on his Yeezy Porn venture against her wishes.<\/p>\n

\n\tIn April, West filed his motion to strike the complaint, claiming the ex-staffer was trying to \u201csuppress\u201d his constitutionally protected right to artistic expression. \u201cYe is not merely a creator; he is art,\u201d the filing said. \u201cYe\u2019s public and private personas form a continuous, provocative performance that challenges societal taboos surrounding race, religion, gender, power, politics, and censorship.\u201d<\/p>\n

\n\tJudge Daum\u2019s predecessor, Judge Theresa M. Traber, denied West\u2019s motion in a scathing June 30 ruling. She said the motion was \u201crife with defects, specious arguments, and misstatements of law.\u201d\u00a0She said the declarations West submitted from alleged witnesses, including one from West\u2019s self-described chief of staff, Milo Yiannopoulos, were \u201ctotally lacking in personal knowledge or proper foundation upon which to base their asserted opinions.\u201d She described the motion as \u201cfrivolous and\/or solely intended to cause unnecessary delay.\u201d<\/p>\n

\n\tFor their part, West\u2019s lawyers argue that Jane Doe \u201cvoluntarily entered a provocative creative environment\u201d and later tried to reframe West\u2019s creative expression as \u201cunlawful.\u201d<\/p>\n

\n\tWest, 48, has been sued more than a dozen times<\/a> since his initial, highly public antisemitic tirade nearly three years ago. In October 2022, West\u00a0tweeted his now-infamous plan<\/a>\u00a0to \u201cgo death con 3 ON JEWISH PEOPLE.\u201d\u00a0Weeks later,\u00a0Rolling Stone<\/em>\u00a0published an investigation that found\u00a0West presided over a \u201ctoxic\u201d work environment at his Yeezy label<\/a>, telling one staffer that \u201cskinheads and Nazis were his greatest inspiration.\u201d West later apologized\u00a0in an Instagram post written in Hebrew<\/a>, but he again promoted antisemitic ideology, sporting\u00a0a T-shirt for the Norwegian metal musician Burzum<\/a>, who has been fined for antisemitism. West also promoted\u00a0Vultures 1<\/em>\u00a0with artwork that evoked Burzum\u2019s cover art.<\/p>\n
