{"id":48553,"date":"2025-10-07T20:32:34","date_gmt":"2025-10-07T20:32:34","guid":{"rendered":"https:\/\/musicianvoice.com\/index.php\/2025\/10\/07\/prosecutors-appeal-decision-to-dismiss-charge\/"},"modified":"2025-10-07T20:32:34","modified_gmt":"2025-10-07T20:32:34","slug":"prosecutors-appeal-decision-to-dismiss-charge","status":"publish","type":"post","link":"https:\/\/musicianvoice.com\/index.php\/2025\/10\/07\/prosecutors-appeal-decision-to-dismiss-charge\/","title":{"rendered":"Prosecutors Appeal Decision to Dismiss Charge"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div id=\"\">\n<p>The band called the decision &#8220;a massive waste of taxpayers money, of police time, of court time&#8221;<\/p>\n<\/p><\/div>\n<div>\n\t\t<!-- do not apply CSS styles to this element! --><\/p>\n<div class=\"pmc-paywall\">\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tProsecutors in the United Kingdom are appealing a judge\u2019s decision to <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/kneecap-mo-chara-terror-case-thrown-out-1235435951\/\">toss the terror-related charge<\/a> <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/kneecap-member-charged-terror-offense-hezbollah-flag-at-1235345328\/\">against Kneecap\u2019s Mo Chara<\/a>.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tAs the <a href=\"https:\/\/www.bbc.com\/news\/articles\/ced57ddgqpyo\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">BBC<\/a> reports, the Crown Prosecution Service announced its decision Tuesday, Oct. 7, with a spokesperson saying, \u201cWe are appealing the decision to dismiss this case as we believe there is an important point of law which needs to be clarified.\u201d\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tThe case against the Belfast rapper \u2014 real name Liam \u00d3g \u00d3 hAnnaidh \u2014 was thrown out last month <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/kneecap-mo-chara-ruling-terror-case-next-month-judge-1235411789\/\">on technical grounds<\/a>, with a judge ruling that the CPS had not filed the charge in time. \u00d3 hAnnaidh was accused of displaying a Hezbollah flag at a November 2024 <a href=\"https:\/\/www.rollingstone.com\/t\/kneecap\/\" id=\"auto-tag_kneecap\" data-tag=\"kneecap\">Kneecap<\/a> concert in London, but the police weren\u2019t made aware of the alleged incident until April 2025, after Kneecap <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/kneecap-coachella-performance-free-palestine-message-1235321677\/\">sparked controversy<\/a> for their <a href=\"https:\/\/www.rollingstone.com\/music\/music-features\/kneecap-responds-coachella-message-palestine-1235322593\/\">criticism of Israel and the war in Gaza<\/a> during their set at Coachella.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u00d3 hAnnaidh was charged not long after in May. But his lawyers \u2014 in their filing to dismiss the case \u2014 argued that the charge was brought one day after the six-month limit for such charges expired. Judge Paul Goldspring ultimately sided with the defense, calling the charge \u201cunlawful and null.\u201d\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tIn a statement shared on <a href=\"https:\/\/www.instagram.com\/p\/DPhCWchAlXg\/?img_index=2\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Instagram<\/a>, Kneecap responded to news of the appeal, saying it was \u201cunsurprising,\u201d but also a \u201cmassive waste of taxpayers money, of police time, of court time.\u201d\u00a0<\/p>\n<section class=\"brands-most-popular \/\/ recirculation-modules trending-in-article lrv-u-margin-tb-2 lrv-u-border-a-2 u-box-shadow-5-5 lrv-u-padding-lr-1 a-span1 u-padding-b-1@tablet u-overflow-hidden\">\n<h2 id=\"section-heading\" class=\"c-heading larva  lrv-u-text-align-center u-border-color-black a-font-theme-primary-xxs lrv-u-color-black lrv-u-text-transform-uppercase u-letter-spacing-0063 lrv-u-padding-t-050 u-padding-b-0375@tablet lrv-u-padding-b-050@mobile-max lrv-u-border-b-2\">\n<p>\t\tTrending Stories<\/p>\n<\/h2>\n<\/section>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tThey continued: \u201cIt is unsurprising because this whole process has not been driven by the police or the courts, it has been driven by politicians backed up by British media. This is political policing. There is no \u2018important point of law.\u2019 The CPS have submitted nothing new in their appeal. What there is though, is a state wide witch-hunt against Palestinian solidarity. The media were gleefully informed about this appeal before we were.\u201d\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tIt\u2019s unclear what \u201cimportant point of law\u201d prosecutors plan on highlighting. At trial, they argued that the notice they gave \u00d3 hAnnaidh of the charge on May 21 \u2014 before the deadline expired \u2014 was official, even though they hadn\u2019t yet received permission from the Attorney General to bring the case. (That came the following day, May 22, one day after the six-month limit passed.)
