At the heart of the dispute between the band and ex-manager is a buyout agreement that was signed when the <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/guns-n-roses-a-report-from-the-road-241423\/3\/\">two sides parted ways<\/a>: Guns N\u2019 Roses allegedly claimed <em>Sound N\u2019 Fury<\/em> violated a confidentiality clause in the agreement, while Niven has argued the confidentiality agreement is \u201cvoid and unenforceable.\u201d\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tA rep for Guns N\u2019 Roses did not immediately return a request for comment.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tAccording to the suit, obtained by <em>Rolling Stone<\/em>, the buyout agreement \u201cwas not signed by all of its members,\u201d which was required for it \u201cto be effective.\u201d (It specifically claims that <a href=\"https:\/\/www.rollingstone.com\/t\/axl-rose\/\" id=\"auto-tag_axl-rose\" data-tag=\"axl-rose\">Axl Rose<\/a> \u201cdid not sign the contract.\u201d)\u00a0 Niven also argues that the members of Guns N\u2019 Roses have essentially violated the confidentiality clause themselves when they\u2019ve previously spoken or written about Niven in ways the filing describes as \u201cinflammatory or even defamatory.\u201d\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tSpecifically, the complaint claims Slash and <a href=\"https:\/\/www.rollingstone.com\/t\/duff-mckagan\/\" id=\"auto-tag_duff-mckagan\" data-tag=\"duff-mckagan\">Duff McKagan<\/a> both wrote about Niven \u201cin a manner that violates the agreement,\u201d and it alleges that Rose has repeatedly spoken about Niven in ways that \u201cviolate the agreement.\u201d\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tNiven\u2019s suit also notes that Guns N\u2019 Roses have never \u201ccomplained\u201d when Niven has responded to quotes about him in the press or talked about the band in interviews. He also alleges that he\u2019s been invited by band members to appear in documentaries about the group and that, between 2015 and 2018, \u201ca member of GNR exchanged emails with Niven multiple times regarding the book and encouraged him to write it.\u201d\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tIn an effort to further cast doubt on the contract, Niven claims he was \u201cunder severe personal distress\u201d when he signed the buyout agreement. The suit states that he had been \u201cbetrayed by his former employee, the band\u2019s lawyer, and his band,\u201d and was \u201cforced to take a buyout that was far less than he would have received had he stayed with GNR.\u201d<\/p>\n<section class=\"brands-most-popular \/\/ recirculation-modules trending-in-article lrv-u-margin-tb-2 lrv-u-border-a-2 u-box-shadow-5-5 lrv-u-padding-lr-1 a-span1 u-padding-b-1@tablet u-overflow-hidden\">\n<h2 id=\"section-heading\" class=\"c-heading larva  lrv-u-text-align-center u-border-color-black a-font-theme-primary-xxs lrv-u-color-black lrv-u-text-transform-uppercase u-letter-spacing-0063 lrv-u-padding-t-050 u-padding-b-0375@tablet lrv-u-padding-b-050@mobile-max lrv-u-border-b-2\">\n<p>\t\tTrending Stories<\/p>\n<\/h2>\n<\/section>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t<em>Sound N\u2019 Fury <\/em>was originally supposed to be published in late June, but the complaint says Guns N\u2019Roses sent Niven\u2019s publisher, ECW Press, a letter in May invoking the confidentiality agreement. \u201c[D]ue to GNR\u2019s threats, <em>Sound N\u2019 Fury <\/em>languishes in a warehouse,\u201d the filing alleges, adding: \u201cThousands of copies of Sound N\u2019 Fury have been printed and continue to incur storage expenses. The release date has been moved several times.
