The lawyers said they expect to file a dismissal of the case with prejudice, meaning they can\u2019t file again, within 60 days.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tThe lawsuit stemmed from a TikTok post <a data-id=\"https:\/\/www.rollingstone.com\/music\/music-news\/lizzo-sydney-sweeney-american-eagle-ad-new-song-1235402779\/\" data-type=\"link\" href=\"https:\/\/www.rollingstone.com\/music\/music-news\/lizzo-sydney-sweeney-american-eagle-ad-new-song-1235402779\/\">Lizzo made last August<\/a>, previewing an unreleased song, \u201cI\u2019m Goin\u2019 in Till October.\u201d In the post, Lizzo was seen washing a Porsche while wearing a denim top. When she sang the lyrics, \u201cBitch, I got good jeans like I\u2019m Sydney,\u201d it was clearly a play on the controversial American Eagle ad slogan, \u201cSydney Sweeney has great jeans,\u201d which was released in July and ignited a firestorm. <\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tCritics called the American Eagle campaign, which featured Sweeney <a data-id=\"https:\/\/www.rollingstone.com\/tv-movies\/tv-movie-news\/sydney-sweeney-addresses-american-eagle-controversy-1235479427\/\" data-type=\"link\" href=\"https:\/\/www.rollingstone.com\/tv-movies\/tv-movie-news\/sydney-sweeney-addresses-american-eagle-controversy-1235479427\/\">talking about her genetic traits<\/a>, a dog whistle for white beauty standards and eugenics. Fox News then <a href=\"https:\/\/www.rollingstone.com\/politics\/politics-news\/fox-news-sydney-sweeney-ad-epstein-scandal-1235401026\/\">blitzed the airwaves<\/a> in defense of the ad campaign, drawing Lizzo into the discourse when one right-wing pundit crowed, \u201cWe\u2019re over this woke agenda. We are over the Lizzos, we are over the Dylan Mulvaneys. If this were a 300-pound non-binary person, they would be applauding her.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tFor its part, GRC Trust filed its lawsuit Oct. 21, claiming Lizzo\u2019s new song infringed on their copyright for the song \u201cWin or Lose (We Tried).\u201d The lawsuit didn\u2019t name the artist behind \u201cWin or Lose,\u201d but it appeared to be referencing a track with the same name from soul artist Sam Dees. GRC Trust previously sued Kanye West with allegations his song \u201cLord Lift Me Up\u201d infringed on Dees\u2019 song, \u201cAlways Keep Your Love (Just Out Of My Reach).\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tThough Lizzo\u2019s song wasn\u2019t officially released, GRC claimed she and Atlantic Records exploited \u201cWin or Lose\u201d and \u201cobtained profits they would not have realized but for their infringement of GRC\u2019s rights.\u201d They asked for disgorgement of the alleged profits in an amount to be decided at trial.<\/p>\n<section class=\"brands-most-popular \/\/ editors-pick-module lrv-u-margin-tb-2 lrv-u-border-a-2 u-box-shadow-5-5 lrv-u-padding-lr-1 a-span1 u-padding-b-1@tablet u-overflow-hidden\">\n<h2 id=\"section-heading\" class=\"c-heading larva  lrv-u-text-align-center u-border-color-black a-font-theme-primary-xxs lrv-u-color-black lrv-u-text-transform-uppercase u-letter-spacing-0063 lrv-u-padding-t-050 u-padding-b-0375@tablet lrv-u-padding-b-050@mobile-max lrv-u-border-b-2\">\n<p>\t\tEditor\u2019s picks<\/p>\n<\/h2>\n<\/section>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tIn a statement shared with <em>Rolling Stone<\/em> last October, Lizzo\u2019s reps said, \u201cWe are surprised that The GRC Trust filed this lawsuit. To be clear, the song has never been commercially released or monetized, and no decision has been made at this time regarding any future commercial release of the song.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tA few weeks after Lizzo shared the TikTok post August, she released the extended edition of her EP <a href=\"https:\/\/www.rollingstone.com\/music\/music-features\/lizzo-my-face-hurts-from-smiling-interview-1235373323\/\"><em>My Face Hurts From Smiling<\/em>,<\/a> this time titled <em>My Face Still Hurts From Smiling<\/em>.
