The federal government has accused Live Nation of using its network of venues to cajole artists into using its promotion services, while also forcing venues to sign exclusive, long-term contracts with Ticketmaster (which it acquired in 2010).\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cToday, the concert ticket industry is broken, in fact the concert industry itself is broken,\u201d U.S. attorney David Dahlquist said during his opening statement (via <em><a href=\"https:\/\/www.theguardian.com\/business\/2026\/mar\/03\/ticketmaster-trial-begins-concert-tickets\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">The Guardian<\/a><\/em>). \u201cIt is controlled by a monopolist. It is controlled by Live Nation.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tLive Nation has denied the allegations, and a lawyer for the company, David Marriott, insisted it \u201cdid not have monopoly power\u201d during his opening statement. He argued instead that the live-entertainment \u201cmarketplace is more competitive than ever it has been before,\u201d and asserted, \u201cEvery customer we get is a hard-fought battle in a competitive market\u201d (via <a rel=\"noreferrer noopener nofollow\" target=\"_blank\" href=\"https:\/\/www.law360.com\/articles\/2448084\/live-nation-tells-jury-it-s-a-fierce-but-legal-competitor\">Law360<\/a>).\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tThe <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/doj-live-nation-ticketmaster-antitrust-suit-1235012538\/\">Department of Justice filed its lawsuit<\/a>, and insisted Live Nation and Ticketmaster be broken up, in May 2024. In the nearly two years it\u2019s taken for the case to reach trial, the government has <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/live-nation-ticketmaster-antitrust-not-dismissed-1235296841\/\">skirted Live Nation\u2019s efforts to toss<\/a> the suit. But the scope of the DOJ\u2019s claims has narrowed, thanks in large part to a pre-trial ruling in February. In that summary judgment, Judge Arun Subramanian dismissed claims that Live Nation has a monopoly over the concert promotion industry, and that its conduct has led to higher ticket prices.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tBut the judge did allow the DOJ\u2019s two most significant claims to remain. First, that Live Nation illegally \u201cties\u201d access to its myriad amphitheaters to its promotion services, meaning any artist that wants to play one of those venues has to use the company as a promoter. Second, the DOJ alleges that Live Nation illegally forces venues to sign long-term contracts with Ticketmaster, as opposed to other ticketing services, in part by threatening to keep popular tours from hitting venues that don\u2019t use Ticketmaster.\u00a0<\/p>\n<section class=\"brands-most-popular \/\/ editors-pick-module lrv-u-margin-tb-2 lrv-u-border-a-2 u-box-shadow-5-5 lrv-u-padding-lr-1 a-span1 u-padding-b-1@tablet u-overflow-hidden\">\n<h2 id=\"section-heading\" class=\"c-heading larva  lrv-u-text-align-center u-border-color-black a-font-theme-primary-xxs lrv-u-color-black lrv-u-text-transform-uppercase u-letter-spacing-0063 lrv-u-padding-t-050 u-padding-b-0375@tablet lrv-u-padding-b-050@mobile-max lrv-u-border-b-2\">\n<p>\t\tEditor\u2019s picks<\/p>\n<\/h2>\n<\/section>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tIn laying out the government\u2019s case, Dahlquist referred to Live Nation\u2019s so-called \u201cflywheel,\u201d a self-reinforcing business model that forces artists to engage with it at the level of venues, ticketing, and promotion. As for how Live Nation\u2019s alleged monopoly affects fans, Dahlquist referenced the chaos that engulfed the on-sale for Taylor Swift\u2019s Eras Tour. Regarding the latter, he argued that Ticketmaster faced so little healthy competition, it had not bothered to make significant improvements to its technology.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tThe prosecutor also brought up Ticketmaster\u2019s infamous fees, which he called \u201cthe highest they have ever been in the Untied States.\u201d Dahlquist further told the jury that it would even see internal Live Nation messages mocking concertgoers, including one that stated Ticketmaster was \u201crobbing them blind, baby.\u201d\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tIn setting up its counter to the government\u2019s claims, Marriott insisted that Ticketmaster takes approximately five percent of ticket prices, and said it only owns a fraction of the more than 20,000 venues in the United States (many of which, especially arenas and stadiums, are owned by sports teams).
