Flagg performs as Maren Wade and has spent the last decade building a career around the branding, \u201cConfessions of a Showgirl.\u201d She first started writing a column for the<em> Las Vegas Weekly<\/em> under that banner in 2014, then turned her musings on showbiz life into a live show and touring production.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tWade trademarked \u201cConfessions of a Showgirl\u201d in 2015, and claims that the \u201csimilarity\u201d between her mark and Swift\u2019s <em><a href=\"https:\/\/www.rollingstone.com\/t\/the-life-of-a-showgirl\/\" id=\"auto-tag_the-life-of-a-showgirl\" data-tag=\"the-life-of-a-showgirl\">The Life of a Showgirl<\/a> <\/em>is \u201cimmediate.\u201d Her lawsuit reads: \u201cBoth share the same structure, the same dominant phrase, and the same overall commercial impression. Both are used in overlapping markets and are directed at the same consumers.\u201d\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tThe lawsuit points out that Swift\u2019s efforts to trademark \u201cThe Life of a Showgirl\u201d have already been stymied by perceived similarities with her own mark. Per the suit, Swift\u2019s team filed a trademark application for \u201cThe Life of a Showgirl\u201d last August, but in November the U.S. Patent and Trademark office issued a partial refusal \u201cbecause of a likelihood of confusion\u201d with a different trademark: Wade\u2019s \u201cConfessions of a Showgirl.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tDespite this refusal, the lawsuit claims Swift and her team never obtained Wade\u2019s \u201cconsent or authorization\u201d to use <em>The Life of a Showgirl<\/em> or any similar mark on their numerous branding and merch endeavors. And, it adds, Swift has \u201ccontinued to use <em>The Life of a Showgirl <\/em>in commerce as a trademark in connection with goods offered to the public.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t(The trademark office suspended Swift\u2019s application earlier this month, putting proceedings on hold. Her <a rel=\"noreferrer noopener nofollow\" target=\"_blank\" href=\"https:\/\/www.instagram.com\/marenwade\/?hl=en\">Instagram<\/a> page is filled with posts using Swift\u2019s music and hashtags like #LifeOfAShowgirl and #TS12. The cover art for a <em>Confessions of a Showgirl<\/em> <a href=\"https:\/\/podcasts.apple.com\/us\/podcast\/confessions-of-a-showgirl\/id1833803576\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">podcast<\/a> Wade teased last summer also made use of a mint green color scheme reminiscent of Swift\u2019s album art. She registered it. She earned it. When Taylor Swift\u2019s team applied to register <em>The Life of a Showgirl<\/em>, the Trademark Office refused, finding Swift\u2019s mark confusingly similar. We have great respect for Swift\u2019s talent and success, but trademark law exists to ensure that creators at all levels can protect what they\u2019ve built.
