\n\tA professional Vegas showgirl has filed a trademark<\/a> infringement lawsuit against Taylor Swift<\/a> over her most recent<\/a> album<\/a>, The Life of a Showgirl<\/a><\/em>.\u00a0<\/p>\n

\n\tThe lawsuit, obtained by Rolling Stone<\/em>, was filed by Maren Flagg. Flagg performs as Maren Wade and has spent the last decade building a career around the branding, \u201cConfessions of a Showgirl.\u201d She first started writing a column for the Las Vegas Weekly<\/em> under that banner in 2014, then turned her musings on showbiz life into a live show and touring production.\u00a0<\/p>\n

\n\tWade trademarked \u201cConfessions of a Showgirl\u201d in 2015, and claims that the \u201csimilarity\u201d between her mark and Swift\u2019s The Life of a Showgirl<\/a> <\/em>is \u201cimmediate.\u201d Her lawsuit reads: \u201cBoth share the same structure, the same dominant phrase, and the same overall commercial impression. Both are used in overlapping markets and are directed at the same consumers.\u201d\u00a0<\/p>\n

\n\tThe lawsuit points out that Swift\u2019s efforts to trademark \u201cThe Life of a Showgirl\u201d have already been stymied by perceived similarities with her own mark. Per the suit, Swift\u2019s team filed a trademark application for \u201cThe Life of a Showgirl\u201d last August, but in November the U.S. Patent and Trademark office issued a partial refusal \u201cbecause of a likelihood of confusion\u201d with a different trademark: Wade\u2019s \u201cConfessions of a Showgirl.\u201d<\/p>\n

\n\tDespite this refusal, the lawsuit claims Swift and her team never obtained Wade\u2019s \u201cconsent or authorization\u201d to use The Life of a Showgirl<\/em> or any similar mark on their numerous branding and merch endeavors. And, it adds, Swift has \u201ccontinued to use The Life of a Showgirl <\/em>in commerce as a trademark in connection with goods offered to the public.\u201d<\/p>\n

\n\t(The trademark office suspended Swift\u2019s application earlier this month, putting proceedings on hold. A final decision hasn\u2019t been made been made yet, though the suspension letter did indicate that the refusal \u201cwill be made final\u201d once the suspension is lifted \u201cunless a new issue arises.\u201d)<\/p>\n

\n\tWhile Wade has filed this lawsuit now, a quick glance at her social media pages suggests there was a brief period where she was very excited for The Life of a Showgirl<\/em>. Her Instagram<\/a> page is filled with posts using Swift\u2019s music and hashtags like #LifeOfAShowgirl and #TS12. The cover art for a Confessions of a Showgirl<\/em> podcast<\/a> Wade teased last summer also made use of a mint green color scheme reminiscent of Swift\u2019s album art. (Wade has been silent on social media since last October.)<\/p>\n

\n\tBut in her lawsuit, Wade claims that her own mark has essentially been swamped by Swift\u2019s Showgirl<\/em> era. \u201cEach additional sale compounds the confusion in the marketplace and further erodes [Wade\u2019s] ability to be recognized as the soul source of her Confessions of a Showgirl<\/em> brand,\u201d the lawsuit reads.\u00a0<\/p>\n

When Taylor Swift\u2019s team applied to register The Life of a Showgirl<\/em>, the Trademark Office refused, finding Swift\u2019s mark confusingly similar. We have great respect for Swift\u2019s talent and success, but trademark law exists to ensure that creators at all levels can protect what they\u2019ve built. That\u2019s what this case is about.\u201d<\/p>\n
