In a motion for a preliminary injunction filed Tuesday, Flagg asked the court to bar Swift from selling goods under the name \u201cThe Life of a Showgirl,\u201d arguing the products are leading consumers astray and crowding her out.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tFlagg says the U.S. Patent and Trademark Office previously \u201crefused\u201d Swift\u2019s application to register \u201cThe Life of a Showgirl,\u201d finding it \u201cconfusingly similar\u201d to Flagg\u2019s \u201cConfessions of a Showgirl\u201d mark. But Swift nonetheless proceeded to sell merchandise without modifying the rejected name, she argues.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cThe confusion the USPTO predicted has materialized,\u201d Flagg\u2019s new filing says, claiming that eight of 10 Google searches for her \u201cexact registered mark now redirect\u201d to Swift\u2019s album title. She says the same search on YouTube returns nine consecutive hits for Swift before any results for Flagg, even though Flagg is the senior trademark holder. \u201cThis is textbook reverse confusion where a junior user\u2019s commercial dominance systematically displaces the senior user\u2019s mark in the mind of the public until consumers come to believe the originator is the imitator,\u201d the new filing states.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201c\u2019Confessions of a Showgirl\u2019 is not one mark among many for plaintiff. It is the only one she has,\u201d the new filing obtained by <em>Rolling Stone<\/em> states. \u201c[Flagg] has built her professional identity under it for more than a decade, and she has no portfolio of alternative brands, no corporate backing, and no global marketing operation to compete for consumer attention. Defendants have all of these. Defendants built a dedicated retail storefront around it, launched collaborations with numerous national brands, and filed a trademark application across fourteen international classes, covering everything from disposable napkins to ponchos. They never contacted plaintiff. They never sought her consent.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tA representative for Swift did not immediately return\u00a0<em>Rolling Stone\u2019s<\/em> request for comment on Tuesday. A hearing on the motion for the injunction is set for May 27 in federal court in Los Angeles.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cMaren spent more than a decade building\u00a0\u2018Confessions of a Showgirl.\u2019 She registered it. She earned it. When Taylor Swift\u2019s team applied to register\u00a0\u2018The Life of a Showgirl,\u2019 the Trademark Office refused, finding Swift\u2019s mark confusingly similar,\u201d Flagg\u2019s lawyer Jaymie Parkkinen tells\u00a0<em>Rolling Stone.<\/em> \u201cWe have great respect for Swift\u2019s talent and success, but trademark law exists to ensure that creators at all levels can protect what they\u2019ve built.
