The judge said she did not see the urgency and would reconsider the matter at a follow-up hearing in June. The judge added Cher could return sooner if another court finds Allman lacks capacity.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tAllman, 49, appeared at the hearing remotely. On a live video feed from his hospital in New Hampshire, he sat in an office chair and spoke only briefly, asking that his former attorney, Steven K. Brumer, represent him and thanking the judge for her ruling.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cI certainly understand the concerns of Mr. Allman\u2019s friends and family regarding his behavior. But those concerns do not necessarily equate to a finding that the proposed conservatee lacks capacity or that a probate conservatorship is appropriate,\u201d Jessica\u00a0A\u00a0Uzcategui said from the bench. \u201cI am going to deny the temporary conservatorship without prejudice.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tFriday\u2019s hearing came more than a year after Cher and Allman reached <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/cher-conservatorship-son-elijah-blue-allman-1235101811\/\">a private settlement in 2024<\/a> that ended Cher\u2019s earlier effort to get control of his trust payments. Cher brought her first petition for a conservatorship in 2023, claiming Allman \u201curgently needed\u201d protection amid \u201csevere mental health and substance abuse issues.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tWhen Cher filed <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/cher-seeks-conservatorship-her-son-elijah-blue-allman-1235548986\/\">her revived petition<\/a> last week, she claimed Allman failed to live up to his promise to hire a business manager. She claimed his life has been derailed again by ongoing substance abuse and mental health issues, and he desperately needs court supervision. \u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cElijah\u2019s situation has become dire on multiple fronts. His mental health has severely deteriorated, his financial situation is terrible, and his drug dependency is at its worst,\u201d her new petition filed April 15 in probate court and obtained by <em>Rolling Stone<\/em> alleges. She called Allman \u201cgravely disabled,\u201d pointing to his recent back-to-back arrests in New Hampshire for allegedly making criminal threats at a school and breaking into a woman\u2019s house.<\/p>\n<section class=\"brands-most-popular \/\/ editors-pick-module lrv-u-margin-tb-2 lrv-u-border-a-2 u-box-shadow-5-5 lrv-u-padding-lr-1 a-span1 u-padding-b-1@tablet u-overflow-hidden\">\n<h2 id=\"section-heading\" class=\"c-heading larva  lrv-u-text-align-center u-border-color-black a-font-theme-primary-xxs lrv-u-color-black lrv-u-text-transform-uppercase u-letter-spacing-0063 lrv-u-padding-t-050 u-padding-b-0375@tablet lrv-u-padding-b-050@mobile-max lrv-u-border-b-2\">\n<p>\t\tEditor\u2019s picks<\/p>\n<\/h2>\n<\/section>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tOn Friday, Cher\u2019s lawyer, Justin Gold, told the court that Allman ended up in custody after traveling to New Hampshire \u201cto apparently visit a friend\u201d and going on \u201csome sort of a spree\u201d that led to his arrests and hospitalization. Gold argued that a financial conservatorship was urgently needed because Allman is burdened by \u201csubstantial debts,\u201d including a $200,000 tax bill and a $6,500-a-month spousal support obligation that he allegedly cannot afford.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cHopefully his health can be handled and improved [in New Hampshire]. And while he\u2019s there improving himself and hopefully being weaned off addiction and getting some medication, his financial ship can be righted,\u201d Gold said. \u201cHe can\u2019t do as much damage in a locked facility, but the damage has been done, and someone needs to deal with it.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tGold said Cher ultimately retained a lawyer to try to reduce the monthly spousal support payments after Allman defaulted in the divorce case. She said the trust distribution set for May did not qualify as an emergency.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cGiven that the proposed conservatee is currently in a psychiatric hospital with pending charges awaiting him, I don\u2019t have any reason to believe he would be able to access any of that distribution for illicit substances or expensive hotels,\u201d she said.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tIn a statement to <em>Rolling Stone<\/em> on Thursday night, Allman\u2019s other lawyer, Avi Levy, said the 49-year-old guitarist for the rock band Deadsy was \u201cdisappointed but not surprised by this latest attempt to gain control over his finances.\u201d The lawyer said he and his co-counsel had \u201cspoken with Elijah several times this week, and he remains in good spirits despite the circumstances.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tWhen Cher <a href=\"https:\/\/www.rollingstone.com\/music\/music-news\/cher-conservatorship-filing-elijah-blue-allman-1234937229\/\">first sought conservatorship control<\/a>\u00a0in December 2023, Allman appeared in court to oppose the effort in person, saying he had stopped using drugs and would get his finances in order. Judge Uzcategui declined to grant an emergency conservatorship then as well and set a more comprehensive hearing on a possible permanent arrangement, but then the parties settled.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tSince 2024, Cher claims, Allman has been \u201cliving wildly beyond his means,\u201d bouncing between \u201cexpensive hotels he cannot afford\u201d and short-term rental homes, allegedly causing more than $50,000 in damage to one Airbnb, and purportedly racking up an $18,000 bill with a drug dealer. <\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tAccording to a bail order obtained by <em>Rolling Stone<\/em>, Allman was arrested on Feb. 27 at St. Paul\u2019s School in Concord, New Hampshire, on suspicion of trespassing, criminal threats, and simple assault. Local outlet <a rel=\"noreferrer noopener nofollow\" target=\"_blank\" href=\"https:\/\/www.wmur.com\/article\/cher-elijah-allman-st-pauls-school-arrest\/70588358\">WMUR 9 News <\/a>reported that Allman allegedly slipped onto campus, claiming he was a prospective parent, turned belligerent, and poked a student with his cane. Allman was booked and released, then arrested again two days later on a burglary rap in Windham, New Hampshire, after a woman called police saying she was \u201chiding in a closet\u201d because someone had broken into her home, a police affidavit obtained by <em>Rolling Stone<\/em> alleges. Officers arrived to find a shattered glass door and Allman \u201cseated on the living room couch smoking a cigarette,\u201d the report says.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tA New Hampshire judge set a June 16 trial for Allman\u2019s Concord school case at a hearing on Monday, <a href=\"https:\/\/www.wmur.com\/article\/nh-trial-elijah-allman-incident-04202026\/71078788\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">WMUR reported<\/a>. Allman did not attend the Monday arraignment hearing in person, the outlet said.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tCher\u2019s documents say Allman receives $120,000 a year via the trust set up by his dad. Once he gets a payment, it\u2019s \u201cimmediately squandered without regard for his liabilities or well-being,\u201d Cher\u2019s court filings say.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\t\u201cThere is a clear pattern in Elijah\u2019s behavior,\u201d Cher alleges in the documents filed by her lawyer. \u201cAfter he receives his trust distribution, he checks into a hotel, usually the Chateau Marmont, buys and does drugs until he runs out of money, ends up in the hospital, or overdoses. Based on this pattern, if Elijah were to receive his trust distribution, he will use it to buy drugs.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \">\n\tAllman\u2019s brother, Devon Allman, submitted a declaration in support of the new conservatorship request. \u201cIt is my opinion that he is currently a danger to himself and unable to manage his life, and any funds that would become available to him,\u201d he wrote. \u201cMy recent visit to check in on him brought me unfortunate and profound sadness that took weeks of my life to process. This time, she\u2019s asking the court to appoint Jason Rubin, a licensed private fiduciary. She\u2019s asking the court to grant Rubin the power to receive her son\u2019s trust distributions and use them to pay Allman\u2019s expenses at his discretion.
