According to a new report, Kevin Costner is asking a judge to dismiss a lawsuit that a stuntwoman who worked on his Horizon film series filed in May, alleging that she was forced to participate in a “violent” and “unscripted” sexual assault scene that she claimed he personally directed.

Devyn LaBella filed suit against Costner and various business entities involved with Horizon on May 27, 2025, alleging that she was “the victim of a violent unscripted, unscheduled rape scene” that Costner directed on May 2, 2023, as part of the second installment of his epic Western.

TMZ reports that the 70-year-old actor, writer and producer has filed new court documents in the case, asking a judge to dismiss the lawsuit.
Costner’s new filing alleges that LaBella seemed perfectly happy with her experience on the shoot afterward, even allegedly texting a supervisor, “Thank you for these wonderful weeks! I so appreciate you! I learned so much and thank you again. I’m really happy it worked out the way it did too. Have a great rest of the shoot and yes talk soon!”
What Does the Lawsuit Against Kevin Costner Allege?
LaBella’s initial filing alleged that she filmed a scripted and rehearsed sexual assault scene the day prior, on May 1, with no problems.
She claimed that when she showed up on set on May 2, she was shocked to find that she was scheduled to shoot another explicit sexual assault scene that she had not known about previously.
According to her complaint, the Oscar-winning actor was “hands on” during the filming of the scene, and he was “either involved in or fully aware of every single thing going on.”
LaBella claimed that Costner personally instructed actor Roger Ivens during the scene, writing notes that included, “Mr. Ivens violently rustled Ms. LaBella’s skirt up as if trying to penetrate her against her will” while “using his body and arms forcibly pinning [her] down.”
She also claimed that there was no intimacy coordinator on the set during the scene, despite contractual requirements.
She made an additional filing on June 18, adding alleged text messages she exchanged with the film’s intimacy coordinator the day after filming the scene that she claims support her position.
Has Kevin Costner Responded to the Horizon Lawsuit Claims?
Not only Costner, but also different cast and crew members from the production have filed declarations with the court that challenge LaBella’s story.
In Costner’s declaration, he recalls that the scene in question featured Ivens and LaBella in a covered wagon.
They were lying next to each other, with LaBella wearing an ankle-length dress and bike shorts underneath.
According to Costner, Ivens lifted the hem of LaBella’s dress and swung his leg over her as she lay beside him.
Ivens ended up on all fours above LaBella, Costner says, but he claims the scene involved no nudity, simulated sexual assault or simulated sex between the performers.
Costner concedes LaBella’s dress may have ended up bunched up at the knees, but says the garment was never above her waist, and her undergarments were never disturbed.
On top of that, “There was no anger or resentment, only enthusiasm and gratitude” at the conclusion of filming, according to Costner’s attorneys, Marty Singer and T. Wayne Harman.
Costner says LaBella’s claims are “absolutely false,” calling them “deeply disappointing.”
